These Terms govern the use of the Service by the User. By accessing the Service or by requesting an Introduction the User accepts these Terms in full.

2.2

A User who does not accept these Terms must not use the Service.

2.3

These Terms constitute the entire agreement between the Provider and the User in respect of the Service and supersede any prior representation or understanding concerning it.

3.Nature of the service

3.1

The Service consists in effecting an Introduction between the User and an Ambassador and in supporting the resulting correspondence. It consists in nothing further.

3.2

For the avoidance of doubt, the Provider:

  1. (a)is not a University, is not an agent of any University, and takes no part in any decision as to admission;
  2. (b)does not act as agent for the User and does not submit, prepare or lodge any application on the User’s behalf;
  3. (c)does not provide immigration, legal, financial or educational advice, and nothing communicated through the Service constitutes advice of any such description;
  4. (d)gives no warranty as to admission, the award of a scholarship, the grant of a visa or residence permit, the availability of accommodation, or any other outcome;
  5. (e)gives no warranty as to the accuracy or currency of information concerning courses, fees, requirements or deadlines, such information being published and amended by the Universities themselves.
3.3

The User is required to verify against the published sources of the relevant University any matter upon which the User intends to rely.

4.Eligibility

4.1

The Service may be used only by persons who have attained the age of 16.

4.2

A User who has not attained the age of 18 is required to read these Terms and the Privacy Policy together with a parent or guardian before using the Service.

4.3

A User who requests an Introduction on behalf of another person warrants that the person concerned is aware of the request and consents to it.

5.Operation of the service

5.1

An Introduction is requested by completing the form published on an ambassador page, which requires the name, surname, electronic mail address and country of origin of the User, together with the declaration referred to in the Privacy Policy.

5.2

Upon submission the Provider opens the Group and notifies the User and the Ambassador. No account is created and no password is issued.

5.3

The correspondence within the Group is conducted between the User and the Ambassador. The assistant operated by the Provider is present in the Group as a disclosed participant and maintains a record of the correspondence, as set out in the Privacy Policy.

6.Telegram

6.1

The Group is hosted on Telegram. Use of the Service accordingly requires the User to hold a Telegram account and to comply with Telegram’s terms of service.

6.2

Telegram is operated by a third party over which the Provider exercises no control. The Provider is not responsible for the availability, performance, or continued operation of Telegram, nor for any restriction imposed upon it in the territory in which the User is situated.

7.Obligations of the user

7.1

The User undertakes:

  1. (a)to provide information that is true, accurate and the User’s own to provide;
  2. (b)not to impersonate another person or to submit the particulars of another person as the User’s own;
  3. (c)not to subject an Ambassador to abuse, harassment or any conduct of a threatening or offensive character;
  4. (d)not to use the Service for any advertising, recruitment or commercial solicitation, nor on behalf of a competing service;
  5. (e)not to extract, scrape or reproduce the Service or any substantial part of it, nor to attempt to access any part of it not made available to the User;
  6. (f)not to use the Service for any unlawful purpose.
7.2

Breach of clause 7.1 entitles the Provider to act under clause 12.

8.Ambassadors

8.1

An Ambassador is a student enrolled at the University named on the relevant ambassador page and is engaged by the Provider. An Ambassador is not an employee, agent or representative of that University and has no authority to act on that University’s behalf.

8.2

An Ambassador corresponds with a User under the authority and instruction of the Provider. The Provider is responsible for the conduct of its Ambassadors in that correspondence, subject to clause 14.

8.3

Statements made by an Ambassador as to that Ambassador’s own experience of study at, or of life in the city of, a University are statements of personal experience and opinion. They do not constitute a representation by any University, do not bind any University, and are not a warranty as to any outcome within clause 3.2(d) nor advice of any description within clause 3.2(c).

8.4

The Provider does not prescribe the content of an Ambassador’s correspondence and gives no warranty as to the promptness or completeness of any reply. Conduct on the part of an Ambassador falling below the standard required by the Provider may be reported at the address given at clause 19.1.

9.Universities

9.1

Each University is independent of the Provider. Neither the making of an Introduction nor the disclosure of the User’s particulars to a University renders the Provider responsible for that University’s admissions process, its decisions, or its treatment of any application.

9.2

Following disclosure, the University processes the User’s personal data as an independent controller under its own privacy policy, as provided at clause 2.3 of the Privacy Policy.

10.Absence of fees

10.1

The Service is provided to the User free of charge. No fee is payable for an Introduction, for correspondence with an Ambassador, or at any subsequent stage.

10.2

Any demand for payment made in the name of the Provider does not emanate from the Provider. The User is invited to report any such demand to the address given at clause 19.1.

11.Intellectual property

11.1

The Students World name and mark, the software constituting the Service, its design, and the materials published within it are the property of the Provider or of its licensors. Nothing in these Terms confers upon the User any right in respect of them beyond the right to access and read the Service.

11.2

Content communicated by the User within the Group remains the property of the User. The Provider processes it solely for the purposes set out in the Privacy Policy.

12.Suspension and termination

12.1

The Provider may suspend or terminate a User’s access to the Service where the User is in breach of clause 7.1 or where the User’s conduct causes or threatens harm to an Ambassador or to another User.

12.2

Save where the conduct concerned requires immediate action, the Provider shall give notice of the ground relied upon and an opportunity to remedy the breach.

12.3

The User may cease to use the Service at any time and without cause. There is no account to close and no notice is required.

13.Warranties and disclaimers

13.1

The Service is provided as it stands. The Provider does not warrant that the Service will be uninterrupted, error-free, or available at any particular time, parts of it depending upon services operated by third parties.

13.2

The Provider may modify, suspend or discontinue any feature of the Service.

14.Limitation of liability

14.1

Nothing in these Terms excludes or limits the liability of the Provider for death or personal injury caused by its negligence, for fraud or fraudulent misrepresentation, for wilful misconduct or gross negligence, or for any other liability which may not be excluded or limited under the applicable law. The rights conferred upon the User as a consumer by mandatory provisions of law are unaffected by these Terms.

14.2

Subject to clause 14.1, the Provider is liable to the User for loss which is a foreseeable consequence of a breach by the Provider of these Terms, and is not liable for loss which is not.

14.3

Subject to clause 14.1, the Provider is in particular not liable in respect of:

  1. (a)any decision of a University concerning an application;
  2. (b)any decision of a public authority, including as to the grant of a visa or residence permit;
  3. (c)loss arising from the User’s omission to verify under clause 3.3 a matter upon which the User has chosen to rely;
  4. (d)the unavailability, performance or restriction of Telegram or of any other third-party service;
  5. (e)the inaccuracy or amendment of information published by a University.

15.Personal data

15.1

The processing of personal data in connection with the Service is governed by the Privacy Policy, which sets out the purposes of the processing, the legal bases relied upon, the recipients, the retention periods and the rights of the data subject.

16.Amendments

16.1

The Provider may amend these Terms. The version in force is published at this address and bears the version number and date of effect stated at its head.

16.2

Where an amendment materially affects the User and the Provider holds an electronic mail address for that User, notice of the amendment shall be given by electronic mail.

16.3

A User who does not accept an amendment may cease to use the Service under clause 12.3, which is exercisable at any time and without charge.

17.Governing law and jurisdiction

17.1

These Terms are governed by Italian law.

17.2

Where the User is a consumer, clause 17.1 does not deprive the User of the protection afforded by the mandatory provisions of the law of the country of the User’s habitual residence, and the User retains the right to bring proceedings before the courts of that country.

17.3

Subject to clause 17.2, the courts of registered office have jurisdiction.

17.4

The User is invited to address any complaint to the Provider in the first instance, at the address given at clause 19.1.

18.Language

18.1

These Terms are drawn up in English and the English text governs.

18.2

Any translation is provided for convenience only. In the event of divergence between a translation and the English text, the English text prevails.

19.Notices and contact

19.1

Notices to the Provider under these Terms are given at support email address.

19.2

Requests concerning personal data are made in accordance with clause 12.1 of the Privacy Policy.

19.3

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions continue in full force.
